Maryann's
practice focuses on insurance coverage and reinsurance
in the areas of environmental, toxic tort, and asbestos
claims She has served as trial counsel in significant
insurance coverage cases, and has argued numerous dispositive
motions and appeals in the insurance coverage area.
- DuPont v. Allstate, et al. ( Del. , 2004): Favorable
summary judgment rulings absolving insurers of coverage
obligation for DuPont's polybutylene plumbing claims.
- Celotex Corp. v. AIU Ins. Co., et al. , 216 B.R.
867 (M.D. Fla., 1997): Judgment in favor of insurers resulting
in no coverage for asbestos bodily injury and asbestos-in-building
claims on late notice grounds following trial in Florida
Bankruptcy Court.
- Diamond
Shamrock v. Aetna , et al. 609 A.2d 440 (1992), cert. denied , 634 A.2d
528 (1993): Affirming jury verdict of no coverage for
dioxin contamination and applying “war risk” exclusion
to bar coverage for servicemen's Agent Orange settlement.

U.S. Dist. Ct., M.D. Fla.) (on appeal to District Court).
Lengthy insurance coverage trial (1993-1996) in bankruptcy
adversary proceeding resulting in a ruling of no coverage
for asbestos bodily injury and building claims for bankrupt
policyholder Celotex.

Ms.
Hayes obtained her undergraduate degree cum laude
from the University of Notre Dame in 1977 and her
law degree cum laude from Loyola University
of Chicago School of Law in 1981. She is a member of the
Illinois bar, the Trial Bar of the United States District
Court for the Northern District of Illinois, the Sixth,
Seventh, and Tenth Circuit Courts of Appeal, and the bar
of the United States Supreme Court.
