Barbara I. Michaelides is Special Counsel at Bates & Carey LLP in the Appellate Practice Group. A seasoned appellate practitioner, Barb has briefed and orally argued appeals across the country in a variety of practice areas, including commercial, first-party property, liability insurance coverage and defense.
Her latest victories include obtaining judgment for a first party property insurer in a large fire loss case involving a law and ordinance sub-limit issue in an appeal before the Fourth Circuit in First Centrum Corp. v. Landmark Am. Ins. Co., 237 Fed. Appx. 799 (4th Cir. 2007). Barb also was instrumental in obtaining reversal of a jury verdict and entry of JNOV for the defense in a class action case taken on direct appeal to the Kansas Supreme Court in Smith v. Kansas Gas, ONEOK, 169 P.3d 1052 (Ks. 2007); and obtaining a new trial in a wrongful death action stemming from a construction accident on the grounds that settling defendants are included in fault allocation under Illinois law in Ready v. United/Goedecke Services, Inc., 854 N.E.2d 758 (Ill. App. 1st Dist. 2006).
In addition to her appellate work, Barb also acts as monitoring appellate counsel in high-exposure cases. Barb assists trial counsel with research and writing dispositive motions, ensures that error is preserved for appeal, thus helping to posture the case for a successful resolution.
She has received numerous awards including the American Jurisprudence Award for Excellence in Civil Procedure, Professional Responsibility and the CALI Excellence for the Future Award in Environmental Law. More recently, Barb was invited to present arguments in the Meridian v. Purkey case before a special session of the Indiana Court of Appeals held at the University of Indiana Law School in front of the entire student body. During argument, the Justices praised Barb’s oral advocacy skills and commented that Barb’s was the only case chosen for this special session based upon the quality of the briefs submitted in the case.
She received a J.D. cum laude from Loyola University Chicago School of Law in 1996; and a B.A. from S.U.NY at Stony Brook New York in 1984.
She is admitted to the Illinois bar, and has been admitted by the following courts to practice: United States Supreme Court, the United States Court of Appeals for the Fourth, Fifth, Seventh, and Eighth, and the District of Columbia Circuits and the United States District Court for the Northern District of Illinois. She is an active member in many professional associations including the Appellate Lawyers Association and the Defense Research Institute – Appellate Advocacy Committee and Amicus Sub-Committee.
