Coverage Disputes
Bates
& Carey LLP attorneys have broad experience advising
and defending insurers on a wide range of coverage issues,
and have represented insurers in some of the largest environmental
and mass-tort cases in the nation.
Our
attorneys have tried large complex insurance coverage
cases to successful conclusions, including Diamond
Shamrock v. Aetna (609 A.2d 440), one of the first
large environmental cases tried, and Goodyear Tire
& Rubber Co. v Aetna Cas. & Sur., in Akron,
Ohio, where the court entered a directed verdict in favor
of the insurers. The Hercules v. Aetna trial in
Delaware absolved our client from paying anything in response
to national pollution claims. Likewise, in the Celotex
bankruptcy proceeding in Tampa, Florida, after many months
of trial on numerous issues of coverage involving asbestos
bodily injury and building claims, our client obtained
a judgment of no coverage. In Stepan v Allstate,
a New Jersey case, the court granted summary judgment
in favor of our client, ruling that Stepan's claims did
not present a justiciable controversy as to our client's
policies. On a more local level, Bates & Carey LLP
attorneys have also litigated and tried high-profile Illinois
cases with enormously favorable results as in Outboard
Marine Corp. v. Liberty Mutual Ins. Co. (670 N.E.2d
740), and Missouri Pacific Railroad Co. v. American
Re-Insurance Co., (1996 WL 501863).
