Our
professional liability practice group serves as coverage
and litigation counsel for domestic and international
insurers in a wide variety of areas including Directors
and Officers Liability, Errors and Omissions Liability,
and Employment Practices Liability.
Directors
and Officers Liability
Our attorneys have successfully handled some of the most
complex D&O claims to date, including claims arising
from the IPO laddering litigation, analyst litigation,
mutual fund litigation, and various corporate scandals.
Our attorneys have significant experience investigating
and evaluating D&O claims, coordinating with our clients'
insureds and their counsel, preparing coverage opinions,
participating in the negotiation and settlement process,
and, when necessary, serving as litigation or arbitration
counsel on behalf of our clients. Our ability to zealously
and successfully represent our clients is a function of
our understanding of the D&O market in general and
our expertise and creativity in evaluating coverage issues,
including issues of misrepresentation and nondisclosure,
"no-loss," notice and reporting, cooperation
and consent, insured capacity, interrelatedness, allocation
and advancement, other insurance, and the application
of various policy exclusions.
Errors
and Omissions Liability
The hallmarks of our E&O practice are our and Accountants
Liability and Architects and Engineers Liability practices.
In an era of increased scrutiny of accountants, our attorneys
have achieved favorable results for our AL clients. We
have also successfully represented our A&E clients
in connection with claims involving design defects, construction
defects, contract interpretation, and liquidated damages
claims. Our attorneys also have significant experience
in various other E&O practice areas, including Lawyer
