Jose Moncada focuses his practice on appellate advocacy, representing corporations, individuals, and other interested parties in state and federal appellate courts nationwide. He draws on years of litigation experience in a broad range of industries, including commercial, cyber, white-collar, trade secret, and bankruptcy disputes.
Prior to joining BatesCarey, Jose practiced at two international law firms in Boston, where he wrote appellate briefs, first-chaired on bench trials, and argued criminal appeals before the Massachusetts Appeals Court. He served as a law clerk in the U.S. Court of Appeals for the Seventh Circuit for the Hon. Michael S. Kanne and in the U.S. District Court for the Southern District of Indiana for the Hon. James R. Sweeney II.
He earned his J.D. from Indiana University in 2020. Before law school, Jose served as an officer in the U.S. Army.
- Represented a leading independent commercial equipment finance company in bankruptcy-related litigation, parallel civil litigation, and government investigations arising from a major Chapter 11 restructuring, managing discovery, witness interviews, and dispositive motion practice.
- Represented the director of a publicly traded acquisition company in expedited arbitration arising from a merger with a major media company, managing discovery, drafting motions, and serving as second chair at the arbitration hearing.
- Represented a global technology and mobility company in trade secret litigation, managing defensive discovery and discovery strategy, drafting dispositive motions, and advising the client’s General Counsel.
- Represented criminal appellants in post-conviction proceedings through the Massachusetts Committee for Public Counsel Services, including appellate briefing and oral argument.
