Jordon Steinway To Lead Training Seminar For Casualty Claims Group

BatesCarey’s Jordon S. Steinway will lead a discussion regarding coverage considerations for social service institutions with a casualty claims group on March 11, 2020 in Rosemont, Illinois.

The program will focus, in particular, on the requisite elements of “effective” reservation of rights letters that fairly inform the insured that coverage for a claim may not be available, that prevent misunderstanding, and that ultimately protect the insurer from potential bad faith exposure. Jordon will walk through the anatomy of an effective reservation of rights letter, from caption to conclusion, and will discuss best practices for the issuance of same.

The adequacy of a reservation of rights is of critical importance and continues to be a source of tension among insurers and their insureds. Recent court rulings throughout the country have underscored the need for a reservation of rights to be clear and unambiguous, timely, and set forth with sufficient specificity so as to fully and fairly convey all potential coverage issues that may impact the extent to which the insured will be entitled to defense and indemnity.
