Abigail Rocap is an associate whose practice focuses on advising and representing insurance carriers in a variety of complex disputes involving professional liability and commercial general liability. Abby regularly provides her insurer clients with comprehensive coverage analysis in coverage disputes involving primary and excess general liability, professional liability, and first-party property claims, including claims involving, derivative actions, employment-related litigation, personal injury suits, products liability and attorney liability. Abby has represented primary and excess insurers in connection with significant class action lawsuits arising from environmental, product defect and cyber claims.
Abby also has extensive experience litigating contested coverage cases regarding major advertising injuries, property damage claims, sexual harassment claims, business interruption claims and coverage issues arising from construction site accidents, including whether contractors and subcontractors qualify as insureds under various liability policies. Abby also has experience litigating issues relating to late notice and the scope of insurers’ duty to defend, including insurers’ obligations to pay for affirmative claims brought by insureds and pre-tender defense fees.
Abby graduated cum laude from Loyola University Chicago School of Law, receiving two CALI Awards for Excellence and was an associate editor of the Children’s Legal Rights Journal.
