Jason P. Minkin, Jonathan A. Cipriani, and Nicole M. Gallagher have published an article in the Kluwer Arbitration Blog entitled “Federal Court Upholds P&I Club’s Coverage Determination as Valid, Binding ADR Decision.”  The article discusses a recent court decision rejecting an argument by a P&I club’s member that the club’s internal claims appeal process was “fundamentally unfair.”  The court reached its decision because, among other reasons, the member had voluntarily agreed to the appeal process as a condition of membership.  A full copy of the article can be found here.
