The pollution exclusion in commercial general liability (CGL) policies is one of the more heavily litigated issues in environmental coverage claims.

Allen will discuss the scope of varying forms of the pollution exclusion in CGL policies, the differing court interpretations of the exclusion which cause inconsistent rulings across jurisdictions and best approaches for insurers to ensure that such exclusions are upheld in court.

Other significant topics to be addressed include how courts make the distinction between traditional and nontraditional sources of pollution and recent developments and case law in applying the pollution exclusion to damages.
